Copyright and Intellectual Property

Effective from: 1st January 2026

1. Content Ownership

All content available on the Frost Fussion platform, including films, series, documentaries, images, graphics, texts, databases, software, soundtracks, videos and all other materials (hereinafter "Content"), is protected by copyright, trademarks and other intellectual property rights under the laws of the United Kingdom and international agreements, including:

• Copyright, Designs and Patents Act 1988
• Trade Marks Act 1994
• Berne Convention for the Protection of Literary and Artistic Works
• WIPO Copyright Treaty
• WIPO Performances and Phonograms Treaty

2. Licence to Use

2.1 Scope of Licence

Frost Fussion grants Users a limited, non-exclusive, non-transferable and revocable licence to access and view Content solely for personal, non-commercial purposes in accordance with these terms and applicable laws.

This licence does not grant you any ownership rights to the Content, and all intellectual property rights remain with Frost Fussion or our licensors.

2.2 Geographical Restrictions

Content is licensed for use exclusively within the territory of the United Kingdom, unless otherwise expressly stated. The use of VPN, proxy servers, or other technologies to circumvent geographical restrictions is strictly prohibited and constitutes a breach of these terms.

2.3 Device Limitations

Streaming is permitted only on devices and in numbers specified in your subscription plan. Unauthorised streaming on additional devices or sharing of account credentials is prohibited.

3. Prohibited Use

Without prior written consent from Frost Fussion, the following is expressly prohibited:

• Copying, downloading, recording, screen capturing, or reproducing Content in any form or by any means
• Distributing, renting, lending, selling, sublicensing, or otherwise making Content available to third parties
• Public performance, broadcasting, or transmission of Content
• Modifying, translating, adapting, creating derivative works, or otherwise altering Content
• Removing, concealing, obscuring, or changing any copyright notices, trademarks, watermarks, or other proprietary rights markings
• Using automated systems, bots, scrapers, or software to extract data or content from the platform
• Decompiling, reverse engineering, disassembling, or attempting to discover the source code of the platform software
• Circumventing, disabling, or interfering with technical protection measures (DRM, access controls, encryption)
• Framing or embedding our Content on other websites without permission
• Using the Content for commercial purposes, including advertising or promotional activities

4. Third-Party Copyrights

Frost Fussion is a licensee of various content providers, production studios, distributors and creators. All copyrights to Content remain the property of the respective rights holders:

• Film studios and production companies (e.g., Warner Bros., Universal, Sony Pictures)
• Television broadcasters (e.g., BBC, ITV, Channel 4, Sky)
• Independent creators and distributors
• Music composers, performers, and record labels
• Writers, directors, and other creative talent
• Other licensed content providers and rights holders

We respect the intellectual property rights of others and require our users to do the same.

5. Trademarks

"Frost Fussion", the Frost Fussion logo, and all related names, designs, logos, and slogans are registered or unregistered trademarks of Frost Fussion Ltd.

Other trademarks, product names, and company names displayed on the platform are the property of their respective owners and are used for identification purposes only.

Use of our trademarks or those of third parties without prior written consent is strictly prohibited and may constitute trademark infringement under UK law.

6. User Content

6.1 Ratings and Reviews

Users may add ratings, reviews, and comments to Content (hereinafter "User Content"). By submitting User Content, you grant Frost Fussion a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable, and transferable licence to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in any media.

6.2 Responsibility for User Content

The User is solely responsible for their User Content and warrants that:

• They own all rights to their content or have obtained all necessary permissions and licences
• Content does not infringe any third-party copyrights, trademarks, patents, or other intellectual property rights
• Content is not defamatory, libellous, obscene, threatening, harassing, or otherwise unlawful
• Content does not contain viruses, malware, or other harmful code
• Content complies with all applicable laws and regulations

6.3 Removal of User Content

Frost Fussion reserves the right to remove any User Content that violates these terms or applicable law, without prior notice.

7. Copyright Infringement Notification

Frost Fussion respects copyright and complies with UK copyright law. If you believe that your copyright-protected content has been used in a manner that constitutes copyright infringement, please contact our designated Copyright Officer:

7.1 Required Information in Notification

Your notification must contain the following information to be valid:

• Identification of the copyright-protected work you claim has been infringed (including title, author, and registration number if applicable)
• Identification of the material you claim infringes copyright and its specific location on the platform (URL or other identifier)
• Your contact details (name, postal address, telephone number, email address)
• A statement that you have a good faith belief that use of the material is not authorised by the copyright owner, its agent, or the law
• A statement that the information in your notification is accurate and that you are the copyright owner or authorised to act on behalf of the copyright owner
• Your physical or electronic signature

7.2 Repeat Infringer Policy

Frost Fussion has a policy of terminating accounts of users who are repeat infringers of copyright in appropriate circumstances.

8. Counter-Notification

If you believe that your content was removed by mistake or misidentification, you may submit a counter-notification to our Copyright Officer with:

• Identification of the material that was removed and its location before removal
• A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification
• Your contact information and consent to jurisdiction of UK courts
• Your physical or electronic signature

9. Database Rights

The Frost Fussion platform contains databases protected under the Copyright and Rights in Databases Regulations 1997. Extraction or re-utilisation of substantial parts of these databases is prohibited without our express written permission.

10. Software Licence

The Frost Fussion software and applications are licensed, not sold. You may use our software only as permitted by these terms. Any unauthorised copying, modification, or distribution of our software is strictly prohibited.

11. Open-Source Software

The Frost Fussion platform uses certain open-source software components. A list of used libraries and their licences is available upon request at:

12. Content Delivery and DRM

Our Content is protected by Digital Rights Management (DRM) technology to prevent unauthorised copying and distribution. You agree not to attempt to circumvent, disable, or interfere with these protection measures.

13. Fair Dealing

UK copyright law provides certain exceptions for fair dealing, including:

• Research and private study
• Criticism, review, and news reporting
• Teaching and education

However, these exceptions do not permit circumvention of our DRM or unauthorised distribution of Content. If you believe your use qualifies as fair dealing, please contact legal@frostfussion.com for guidance.

14. Sanctions for Infringement

Violation of these copyright provisions may lead to:

• Immediate termination of your user account without refund
• Civil liability for damages under the Copyright, Designs and Patents Act 1988
• Criminal prosecution where applicable under UK law
• Permanent ban from accessing Frost Fussion services
• Legal action to recover damages and legal costs

16. Changes and Updates

Frost Fussion reserves the right to change these copyright terms at any time. We will inform you of significant changes through a notice on the platform or by email at least 30 days in advance.

17. Governing Law

These copyright terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
